Privacy Policy

The short version: We collect what we need to take your order, ship it, and stay in touch if you want us to. We don’t sell your information. You can ask us to see it, correct it, or delete it any time.

This covers mobettahbands.ca, run by Mo Bettah Bands Inc., a Canadian corporation.

When you order here, Mo Bettah Bands Inc. is the company accountable for your personal information. Our US storefront is operated by our subsidiary, Mo Bettah Bands USA Inc., under its own privacy policy; we may share information between the two companies where it is needed to run the business, and both apply the protections described here.

Who’s responsible for your information

Our Privacy Officer is the Privacy Officer, Mo Bettah Bands Inc., reachable at support@mobettahbands.com and 1656 Quinn Street South, Prince George, BC V2N 1X3.

Canadian privacy law requires us to designate someone accountable for the personal information we hold, and that’s who this is. If you’d like their name, just ask.

What we collect

  • When you order: your name, email, shipping and billing address, phone number if you give it, and what you bought. Your card details go to our payment processor; we never see or store your full card number.
  • When you browse: your IP address, browser and device type, time zone, pages and products viewed, search terms, and how you found us. Collected automatically through cookies, pixels, and similar tools.
  • When you contact us or sign up: whatever you send us, plus your email if you join our list.
  • When you post a review or tag us on social media: we keep a copy of what you wrote or posted, along with the name or handle you posted it under, so we can display it and reply to you.

Why we have it

To take payment, ship your order, handle returns and warranty claims, answer your questions, screen orders for fraud, meet our tax and legal obligations, understand what’s working on the site, and, if you’ve consented, send you email about new products and offers.

We collect, use and disclose your information for purposes a reasonable person would consider appropriate in the circumstances, and only for the purposes described here.

Where we need your consent, we ask for it; you can withdraw it at any time by emailing us, subject to legal and contractual limits we’ll explain if they apply.

Marketing email (CASL)

We only send marketing email to people who have given us express consent, or where we have implied consent under Canada’s Anti-Spam Legislation, for example, because you bought something from us in the past two years.

Every marketing email identifies us, gives our mailing address, and includes an unsubscribe link that works for at least 60 days. We action unsubscribes within 10 business days.

Order confirmations, shipping notices and warranty correspondence are transactional and aren’t marketing.

Who we share it with

Only the companies that help us run the shop:

  • Shopify, which hosts our store and processes orders (shopify.com/legal/privacy). Shopify also runs limited automated fraud screening, such as temporarily blocking IP addresses or cards tied to repeated failed transactions. This doesn’t have any legal or significant effect on you.
  • Shopify Payments and the card networks, plus Shop Pay, Apple Pay and Google Pay, which process your payment
  • Shipping carriers, so your package arrives, including Canada Post
  • Klaviyo, if you’re on our email list
  • Judge.me, if you leave a review
  • Analytics and advertising providers, see below

We may also share information to comply with the law, respond to a subpoena or lawful request, protect our rights, or if the business is sold.

We do not sell your personal information.

Advertising and cookies

We use Google Analytics to understand how the site is used, and advertising pixels from Meta, Google Ads and TikTok to measure our ads and show them to people likely to be interested.

This involves tracking your activity across websites, which requires your consent in Canada for anything beyond the cookies strictly needed to run the site.

Our cookie banner lets you accept or decline non-essential cookies before they’re set. You can change your mind any time using the cookie preferences link in our footer, or by emailing support@mobettahbands.com.

We honour Global Privacy Control signals from your browser. You can also opt out directly with the platforms:

Cookies themselves range from essential (cart, checkout, login) to analytics and advertising.

You can block them in your browser settings; the essential ones are needed for checkout to work, so blocking everything may break parts of the site.

Your rights

Wherever you live, you can ask us to:

  • Tell you what information we have about you and who we’ve shared it with
  • Correct anything that’s wrong
  • Delete your information
  • Send you a copy in a portable, machine-readable format
  • Stop using it for targeted advertising
  • Withdraw consent, or unsubscribe from marketing email. Every email has a link, or just tell us.

Email support@mobettahbands.com and we’ll respond within 30 days. We may need to confirm it’s really you first. We won’t treat you differently for asking, and we won’t charge you.

Canadians have these rights under the federal Personal Information Protection and Electronic Documents Act (PIPEDA), and, depending where you live, under the Personal Information Protection Act in British Columbia or Alberta.

If we can’t resolve your complaint, you can contact the Office of the Privacy Commissioner of Canada (priv.gc.ca, 1-800-282-1376), or your provincial commissioner: the Office of the Information and Privacy Commissioner for British Columbia (oipc.bc.ca) or the Office of the Information and Privacy Commissioner of Alberta (oipc.ab.ca).

If you’re ordering from the US, the UK or the EEA, the rights in those jurisdictions also apply to you, including CCPA/CPRA rights for California residents and UK GDPR/GDPR rights for UK and EEA residents.

Our lawful bases in those jurisdictions are contract (fulfilling your order), legitimate interests (running and improving the shop, preventing fraud), consent (marketing and non-essential cookies), and legal obligation (tax and accounting records).

If something goes wrong

If personal information we hold is lost or accessed without authorization and it creates a real risk of significant harm to you, we’ll notify you and the Office of the Privacy Commissioner of Canada as required by law, and we keep records of any such incident.

How long we keep it

Order records for six years, because tax law requires it. Marketing contacts until you unsubscribe. Support emails for two years. Browsing data per the cookie durations above; most cookies expire between 30 minutes and two years. Records of CASL consent for three years after consent is withdrawn.

Where it goes

Our store runs on Shopify and some of our providers store or process information in the United States and other countries.

That means your information may be handled outside Canada, and may be accessible to courts, law enforcement and national security authorities of those countries under their laws.

We use providers who commit to appropriate safeguards, and we require them to protect your information to a standard comparable to ours.

Security

The site runs on HTTPS and payments are handled in Shopify’s PCI-compliant environment.

No system is perfect, but we take reasonable steps to protect what we hold and limit who can see it.

Age

You need to be the age of majority in your province to order from us, and our site isn’t directed at children.

We don’t knowingly collect information from minors. If you think we have, email us and we’ll delete it.

Changes

We’ll update this page when our practices change and update the date at the top.
